A me non sembra che la distinzione sia priva di importanza. Posso essere d'accordo sul fatto che il matrimonio dovrebbe essere contratto, ma nel nostro ordinamento non lo è. E non mi pare semplicemente una vuota questione terminologica: che cosa, della disciplina dei contratti, si applica al matrimonio? Già solo il fatto che sia impossibile concludere atti atipici di unione mi sembra una differenza enorme.

Il fatto che anche il matrimonio sia basato sull'accordo e che riguardi anche questioni patrimoniali mi pare un po' poco per poterlo chiamare con tanta semplicità contratto, allo stato attuale. Come riconosci anche tu, questa mi sa più di battaglia ideologica (tutt'altro che sbagliata, intendiamoci).
